What is registration and what types of proof does CIPO require to register a document?

Registration refers to the process of filing or recording a document. The Commissioner is obligated to register any document relating to a patent or application upon request of any person and upon payment of a registration fee (see item 21 of Schedule II).

The type of proof required depends on the type of document being registered. Generally, proof is only required if registration is related to an assignment document. Examples of the types of proof that will be accepted in support of the registration of an assignment document are:

  • an affidavit of a subscribing witness;
  • the signature of a witness on the document;
  • the signature of the assignor if either the assignor or the agent on record indicates on the covering letter that the transfer or agreement was signed by the assignor; or
  • a corporate seal on the document.
