1. Formalities

If your filed application is in good order and you have included the correct fee, we will assign a number and a filing date to your application and open a file.

How we'll inform you… …and when Fees
You will receive a filing certificate. …within 4 weeks of receipt of your application. Filing (Item 1)
If your application is incomplete, you will be notified by mail about the deficiencies. …within 4 weeks of receipt of your application. Completion of application (Item 2)

If your application is still incomplete after 15 months from the priority date or from the filing date, you may have to pay a completion fee.

PCT application
If your filed application is in good order and you have included the correct fee, we will assign a number and a national entry date to your application and open a file.
You will receive an acknowledgement of national entry …within 8 weeks of receipt of your application Filing (Item 1)
If your application is incomplete, you will be notified about the deficiencies by mail. …within 8 weeks of receipt of your application Completion of application (Item 2)

If your application is still incomplete after the three-month period following the entry into the national phase, you may have to pay a completion fee.

2. Classification

Your application is classified according to the international patent classification (IPC) system within the applicable technical field.

How we'll inform you… …and when Fees
You will not be informed of this stage. …within 6 weeks after the date of filing in Canada. The information is available when your application becomes open to public inspection N/A

3. Public Availability

Your application becomes open to public inspection. A copy is made available in the Patent Public Search Room and can be accessed via our Web site.

How we'll inform you… …and when Fees
You will not be informed of this stage. 18 months after the date of filing in Canada, or 18 months following the date of foreign filing, whichever is first (priority date). N/A
