Effective immediately, the Registrar will generally no longer require an applicant for registration of a trademark to confirm that it is a "person" as defined in Section 2 of the Trade-marks Act. The onus rests ultimately with the applicant to ensure compliance with the Act.

This practice notice is intended to provide guidance on current Trademarks Office practice and interpretation of relevant legislation. However, in the event of any inconsistency between this notice and the applicable legislation, the legislation must be followed.
