Proposed Practice Notice: Persons

Effective immediately, the Registrar will generally no longer require an applicant for registration of a trade-mark to confirm that it is a “person” as defined in Section 2 of the Trade-marks Act (the Act).   The onus rest ultimately with the applicant to ensure compliance with the Act.

Note: This practice notice is intended to provide guidance on current Trade-marks Office practice and interpretation of relevant legislation. However, in the event of any inconsistency between this notice and the applicable legislation, the legislation must be followed.
