Consultation and Discussion
As part of the Canadian Intellectual Property Office's (CIPO) commitment to provide quality and timely intellectual property rights, the Trade-marks Branch is requesting your participation in a consultation on three (3) proposed practice notices. These are intended to clarify the Trade-marks Office practice regarding the confirmation of a “person” as defined in Section 2 of the Trade-marks Act, the requirements regarding the description of colour claims as well as advising of a change in practice regarding an opposition deemed withdrawn and an application deemed abandoned in opposition and clarifying the practice regarding an application deemed abandoned for failure to file a Declaration of Use.
For more details on the suggested changes, your attention is directed to the proposed practice notices entitled “Persons”, Description of Colour Claims and Opposition Deemed Withdrawn, Application Deemed Abandoned.
Any comments you may wish to submit will be reviewed during the consultation period and will be considered prior to being posted on this website. Your comments are appreciated and will add value to the process of finalizing our practice notice. Please note that all comments will be retained online for three (3) months from the date of posting.
