Instructions for Form 7.

General Note:
Form 7 has been drafted to cover the case where the trademark has been used in Canada in association with the goods or services to which the statement of goods or services is to be extended. In other cases paragraphs 2 and 3 of the form will require modification. For this purpose, where the application is based on making known in Canada, paragraphs 4 and 5 of Form 2 may be adapted; where the application is based on registration and use abroad, paragraphs 4, 4A, 5 and 5A of Form 3 may be adapted; and where the application is based on a proposed use, paragraphs 4 and 5 of Form 4 may be adapted.

(a) Insert the name of the registered owner.

(b) Insert the date of registration.

(c) List the specific goods to which the statement of goods in the registration is to be extended. The goods must be described in ordinary commercial terms.

(d) List the specific services to which the statement of services in the registration is to be extended. The services must be described in ordinary commercial terms.

(e) Any other desired amendments authorized by subsection 41(1) of the Act, e. g. the cancellation of certain goods or services from the statement of goods or services in the registration, should be set out here.

(f) Insert this phrase only if the trademark has been used in Canada by a predecessor of the applicant in association with any of the specific goods listed above in accordance with note (c). If so, name the predecessor who began to use the trademark in association with any of the specific goods listed and name also any intervening predecessor down to the applicant.

(g) If all the specific goods listed above in accordance with note (c) fall into a single general class, list them all again here. If such goods fall into more than one general class, list here only those falling into one general class.

(h) Give the earliest date when the applicant or a predecessor began to use the trademark in Canada in association with any of the goods listed in accordance with note (g).

(j) List here any of the specific goods which have been listed above in accordance with note (c) but fall into a different general class from that comprising the goods listed in accordance with note (g).

(k) Give the earliest date when the applicant or a predecessor began to use the trademark in Canada in association with any of the goods listed in accordance with note (j).

(l) If the specific goods listed above in accordance note (c) include goods falling into further different general classes, repeat here the words "and in association with the general class of goods comprising the following specific goods.......... since.........." as often as necessary, listing in each case the specific goods falling into a different general class from those comprising the goods previously listed in this paragraph and giving in each case the earliest date when the applicant or a predecessor began to use the trademark in Canada in association with any such goods.

(m) In completing this paragraph, notes (f) to (l) should be read with the substitution of "services" for "goods" and with a reference in the case of notes (f), (g), (j) and (l), to note (d) instead of note (c).

(n) Insert "goods", "services" or "goods and services" as applicable.
