Intellectual Property Law Improvement Act — Registered User

As a result of the coming into force of the Intellectual Property Law Improvement Act, the following outlines the Office Practice and Procedures concerning the repeal of Section 50 of the Trade-marks Act.
All the requests, received before June 9, 1993, for the registration, cancellation or the variation of a user of a registered Trade-mark will be processed as the services were or will be rendered.
All the requests, received before June 9, 1993, for the registration, cancellation or the variation of a user of a pending Trade-mark that is not registered as of June 9, 1993, will not be processed. The fees received to effect such registrations will be refunded and the requests will be returned in due course.
All the requests, received on or after June 9, 1993, for the registration, cancellation or the variation of a user of either a pending or registered Trade-mark will not be processed. The fees received to effect such registrations will be refunded and the requests will be returned in due course.
It is the intention of the Trade-marks Branch to store all registered user files at the National Archives of Canada once the Section closes in March, 1994. The files would still be available, upon request, via the Trade-marks Records Office within 1 to 3 working days.
