Why

The Government of Canada is modernizing Canada's intellectual property (IP) framework so that we can join five international IP treaties, including the Patent Law Treaty (PLT).

Participation in these international agreements will better align Canada's IP systems with our major international trading partners, making it easier for innovative Canadian businesses to protect their IP at home and abroad. It will also help to make Canada a more attractive destination for foreign investment and encourage companies to bring innovations to market more quickly, to the benefit of Canadian consumers.

We have already made amendments to the Patent Act to comply with the requirements of the PLT, and are now in the process of amending the accompanying Rules which will guide us on how the Act is applied.

This consultation specifically pertains to the draft administrative topics of the Manual of Patent Office Practice (MOPOP) which will need to be revised in anticipation of the new Patent Act and the Patent Rules, which have an expected coming into force in Fall 2019. The Office has prepared draft topics which will be integrated into the revised MOPOP at that time. In line with our commitment to inclusive, meaningful, open, transparent and balanced consultations, we want to hear your views and comments on the draft administrative MOPOP topics.

Please note that the draft MOPOP topics have been prepared on the basis of the proposed new Patent Rules, as published in the Canada Gazette, Part I, on . These drafts will be subject to further edits and improvements before the coming into force of the new Patent Act and the new Patent Rules therefore we encourage stakeholders to provide comments and feedback.

What we heard

This public consultation on draft administrative topics for the new Patent Rules in the MOPOP was an opportunity for you to learn about the new processes and procedures that will apply when the new Patent Act and the new Patent Rules come into force, subject to approval, expected in Fall 2019. Individuals were encouraged to read the draft administrative MOPOP topics listed below and were invited to ask questions and provide comments related to them.
